The combination of travel services offered to you constitutes a package tour within the meaning of Directive (EU) 2015/2302. Therefore, you can claim all EU rights that apply to package tours. Discover Sumatra takes full responsibility for the proper execution of the entire package tour. Additionally, Discover Sumatra has the legally required insurance to refund your payments and, if transportation is included in the package tour, to ensure your repatriation in the event of its insolvency.
Information regarding professional liability insurance
Name and registered office of the insurer:
- Tour operator liability insurance with Bernhard Assekuranzmakler GmbH, Mühlweg 2 b, 82054 Sauerlach
- Surety insurance with R+V Versicherung AG, Raiffeisenplatz 2, 65189 Wiesbaden
Key rights under (EU) 2015/2302
- Travelers will receive all essential information about the package tour before concluding the package travel contract.
- Travelers are provided with an emergency telephone number or details of a contact point where they can get in touch with the organizer.
- Travelers may transfer the package tour to another person, on reasonable notice and possibly subject to additional costs.
- The price of the package tour may only be increased if specific costs (e.g., fuel prices) increase and if this is expressly provided for in the contract, and in any case not later than 20 days before the start of the package tour. If the price increase exceeds 8% of the package tour price, the traveler may terminate the contract. If a travel organizer reserves the right to increase the price, the traveler has the right to a price reduction if the corresponding costs decrease.
- Travelers may terminate the contract without paying a termination fee and receive a full refund of any payments if any of the essential elements of the package tour, other than the price, are significantly changed. If the trader responsible for the package tour cancels the package tour before it starts, travelers are entitled to a refund and compensation where appropriate.
- Travelers may terminate the contract without paying a termination fee before the start of the package tour in the event of extraordinary circumstances, for instance, if there are serious security problems at the destination which are likely to affect the package tour.
- Additionally, travelers may terminate the contract at any time before the start of the package tour on payment of a reasonable and justifiable termination fee.
- If, after the start of the package tour, significant elements of the package tour cannot be provided as agreed, suitable alternative arrangements must be offered to the traveler at no extra cost. The traveler may terminate the contract without paying a termination fee (in the Federal Republic of Germany, this right is called “Kündigung”) if services are not performed in accordance with the contract, this has substantial effects on the performance of the contractual package travel services, and the organizer fails to remedy the problem.
- The traveler is entitled to a price reduction and/or compensation for damages if the travel services are not performed or are improperly performed.
- The organizer must provide assistance to the traveler if the traveler is in difficulty.
- If the organizer or – in some Member States – the retailer becomes insolvent, payments will be refunded. If the organizer or, where applicable, the retailer becomes insolvent after the start of the package tour and if transport is included in the package tour, repatriation of the travelers is secured. Discover Sumatra has taken out insolvency protection with R+V Versicherung AG, Raiffeisenplatz 2, 65189 Wiesbaden, Germany. Travelers may contact this entity if services are denied due to the insolvency of Discover Sumatra.
